BAIL APPLICATION TO RESUME TODAY (THURSDAY)
During Wednesday's (11/2/09) application for bail in the High
Court Mr. Michael Forde Senior Counsel for Sean Garland gave a comprehensive and detailed outline of the reasons why Sean
had not returned to Northern Ireland to answer the request from the United States authorities for extradition from the UK
to the US. Mr. Forde pointed out that Sean's rights as an Irish citizen could not be guaranteed to him in a British court
and that upon his return to Dublin Seán had notified the Gardaí and the Department of Justice of his whereabouts here in the
Republic.
Stating that there would be a robust and comprehensive defence of the extradition request served here in
the Republic, Michael Forde said that in these circumstances there was no risk of Sean not honouring bail conditions agreed
here.
After hearing submissions Judge McMenamin directed the gardaí to return to court Thursday morning (Feb
12th) with further information relating to possible conditions for bail here in the Republic.
